What to expect if you or a companion are arrested during the Sturgis Motorcycle Rally:
Class 2 Misdemeanor
If you receive a citation/summons for a Class 2 Misdemeanor during the Sturgis Motorcycle Rally, chances are, you will not be arrested and will not be spending the night in jail. You will be advised of the fine and given a court date where you can appear if you wish to contest the ticket.
Class 1 Misdemeanor
If you are arrested for a Class 1 Misdemeanor during the Sturgis Motorcycle Rally (e.g., DUI/DWI/Drunk driving, possession of marijuana, simple assault), you will be spending the night in jail. You will be given a mandatory court appearance in the morning, where you will have the opportunity to post bond. For a misdemeanor charge, an attorney can appear in court on your behalf. That means, you can either get back to the party or get home without having to attend court.
If you are arrested for a felony during the Sturgis Motorcycle Rally, you will be spending the night in jail. You will be given a mandatory court appearance in the morning, where you will have the opportunity to argue that you should be released on bond.
